General Information for Public Records Requests
Under Washington law, RCW 10.97 entitled “Washington State Criminal Records Privacy Act” governs what records you will be able to access under Washington’s Public Records Act.
Once your petition is filed with the Clemency and Pardon’s Board, the board will contact the prosecuting attorney’s offices and request whatever information they have regarding your criminal case, i.e. police reports, victim information, eye witness statements, admissions, etc. In order to fully prepare yourself for your interview, it is essential to gather as much information as possible regarding your past criminal history.
To gather information and retrieve copies of your police reports, you are going to have to make your own public records request to the arresting agency. In order to do this, you must contact the police department in the jurisdiction in which you were originally arrested and follow their public records request procedures. Although each police department and prosecutor’s office is subject to the Public Records Disclosure Act, each department has their own individual procedures. Below is a list of local prosecutor’s offices and sheriff’s offices to get you started. Each department should have a designated “Record’s Custodian.”
Because each police department has their own internal procedures for providing public records, there is no uniformity; and thus, some people may encounter agencies that are not complying with the public records act. If this is the case, it is imperative to take immediate action and contact the American Civil Liberties Union as soon as possible. Their contact information is listed below.
